Terms of Service

1. The service

Toucan Intelligence (the “Service”) is an analytics platform operated by Toucan International (“we”, “us”). The Service analyses how brands appear in responses generated by third-party AI systems (including ChatGPT, Gemini, Claude, and Perplexity), and produces reports about brand mentions, citations, and related metrics.

AI-generated content is probabilistic: the same question can produce different answers at different times. Reports describe what the Service observed at the time of analysis and are provided for informational purposes. They are not guarantees of how any AI system will behave, and should not be the sole basis for business decisions.

2. Accounts

You need an account to use the Service. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. You must be at least 18 and authorised to act for the organisation you register.

During the beta period, access is by invitation and free of charge. We may change, suspend, or discontinue beta features at any time.

3. Subscriptions and payment

Paid subscription tiers, including their prices and limits, are described on our pricing page. Fees are billed in advance on a monthly or annual cycle and are non-refundable except where required by law. We may change prices with at least 30 days' notice, effective from your next billing cycle.

Plan limits (such as the number of tracked queries and monthly analysis runs) apply to each tier. We may throttle or decline usage that exceeds your plan's limits.

4. Acceptable use

You agree not to: misuse, probe, or disrupt the Service; attempt to access other customers' data; resell or white-label the Service without our written agreement; use the Service to violate any law or third-party right; or introduce malicious code.

The Service queries third-party AI providers on your behalf. You agree not to configure queries whose content is unlawful or that would cause us to breach those providers' terms.

5. Your data and our IP

You retain all rights to the configuration you provide (brands, competitors, queries) and to your business data. You grant us the licence needed to operate the Service — including sending your queries to AI providers and storing the resulting analyses for your account.

We retain all rights to the Service, including its software, design, scoring methodologies, and report formats. Aggregated, anonymised usage data may be used to improve the Service.

6. Third-party services

The Service depends on third-party AI providers and, where you connect it, Google Analytics. Their availability and output are outside our control. If you connect a Google Analytics property, you confirm you are authorised to grant that access, and you can disconnect it at any time from Settings.

7. Availability and support

We aim for high availability but the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. Support is provided by email as described on our Support page.

8. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data. Our total liability for any claim arising out of the Service is limited to the fees you paid us in the 12 months before the claim arose (or £100 if you have paid no fees).

Nothing in these terms excludes liability that cannot be excluded by law.

9. Termination

You may cancel at any time from Settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate accounts that breach these terms. On termination we will, on request, delete your account data in line with our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. For material changes we will give reasonable notice by email or in-app. Continued use of the Service after a change takes effect constitutes acceptance.

11. Contact and governing law
